CSHOA Governing Documents

A Home Owners Association (HOA) is a managed community with a formal structure designed to function in a way that protects the common interests of Association members and the community.  The Governing documents of the HOA define the terms and conditions under which the HOA and residents operate.  A requirement of ownership in the community is acceptance of these documents.  While each document has an important purpose, there is a hierarchy in which some documents take priority over others.  The documents, in order of their precedence are:

  • Local, State, and Federal Laws
  • Declaration of Covenants, Conditions, and Restrictions
  • Articles of Incorporation
  • Bylaws
  • Operating Rules and Regulations

The Declaration is the most important document in the set below Local, State, and Federal Laws.  It states the division of power between the HOA and its members, along with the rights and responsibilities of each. The Declaration contains provisions related to assessment obligations of its members, association and member maintenance responsibilities, architectural control powers, association enforcement authority, dispute resolution, property use restrictions, and insurance requirements.  The Declaration sets the stage for the nature of the relationship of authority between the HOA and residents. The formal title for our Declaration is “Declaration of Covenants, Easements, Charges, and Liens of Chesapeake Station.

The Articles of Incorporation create the Association as a non-stock, non-profit corporation and define its legal name, address, and corporate status.  The Articles are filed with the State.

The Bylaws define how the HOA operates as a corporation.  Bylaws describe who directs certain aspects of the HOA’s responsibilities.  The Bylaws also define the number of Directors, frequency of elections, and other procedures that are specific to the HOA.

The Operating Rules & Regulations are developed by the HOA Board of Directors to determine how the day-to-day procedures will operate in the HOA.  Our operating rules are contained in a Book of Policy Resolutions.  There are currently 7 Resolutions:

  5. Keeping and Controlling of Pets

Printed copies of the above documents may be ordered through WelcomeLink. Note that owners who rent their property in Chesapeake Station must make their tenants aware of the guidance and restrictions on Chesapeake Station residents described in the above documents.

The above documents and a resale certificate must be conveyed by Sellers to the Buyer of any home in Chesapeake Station.  Resale packages and/or HOA documents required by lenders may also be ordered from WelcomeLink. Note that requestors must create a login account.
